Seems like I missed a good ole' kerfuffle yesterday regarding stuff said on fandom_wank, and ergo missed all the amusement of Smurfie and DD's National Censorship Day

I'm wondering what the legal arguments are FOR fanfic as aopposed to against it...?
Shoulda' studied law, I'm randomly interested now.

I mean, in a logical sense, it's plainly not affiliated with the original creator, it's blatantly in no way official and it's pasted with warnings to the effect that it's wholly innapropriate for children. In that respect I would have wondered exactly what legal holdings the original creator would have had over fanfic sites, but then no one ever said the law was rational.
I mean, yes, it's their characters, but it's not even pretenting to be official, so it's not even like it comes under the same arm as pirated goods.
See, things like this randomly get me wondering. I'm thinking it's a sign I'm getting too much downtime to think about things...
It's also the problem run when you write something originally aimed at kids which becomes so unusually popular with adults. You're going to get a subculture and, no matter how many cease and decist letters you send out, it's going to keep on coming.
With the way the internet is, it's so astoundingly hard to police it wouldn't surprise me if the entire archive reappeared in about 3 months time just at a slightly different location.
Just my 2 cents though. I figure if I created something that was popular enough to be fan-ficced I'd be flattered. Never mind if it was originally appropriate material for the slash writers or the smut writers or what-the-fuck-ever-writers.
As Allende and I had discussed so many times while writing the WTHKOP saga, it's a haven for fan-ficcers. Rachie said the exact same thing when working on the comic she wanted to draw.
If you create something popular, fan-fic will follow, it's just the way of the world.
Well, the way of the internet anyway, which is naturally run on sex and shopping just like any other social collective.

Yep, I'm definitely bored. I'm pondering the social origins of online culture and the evolution of societies... I need to go and get a life or something...
